Case Responses

Rupture of breast implant following kenalog injection (Case #125)

  • Medical Probability: 10 / 10
  • Medical Error Summary: The dermatologist should not have been injecting with sharp needles in proximity to the breast implant. Silicone breast implant rupture at one year post op would be extremely rare under any circumstan...
  • Causation Probability: 9 / 10
  • Causation Summary: Hard to explain a reason for breast implant rupture at one year post op absent another explanation.
  • Expert Summary: I have been a board certified plastic surgeon for over forty years with much experience in breast implants. . I present well and know the difference between fact and opinion.
  • Similar Summary: I see several cases of breast implant rupture annually over many years. In this specific case, i have never encountered a case where a dermatologist felt comfortable injecting scars connected to an un...

  • Causation Probability: 5 / 10
  • Causation Summary: Cannot be determined without full case review. Poor technique can cause the injury but so can good technique and bad luck. It depends on the detailed documentation to make reasonable difference.
  • Expert Summary: I have had a long career, done many cases of this type and have seen complications of this type before, both from my community and personally
  • Similar Summary: Less than one annually over a forty year career. Clarification: I have seen hundreds of breast implant problems, hundreds of abdominoplasties, hundreds of liposuctions. Complications of each are infr...

  • Medical Probability: 2 / 10
  • Medical Error Summary: Delayed wound healing or post op wound dehiscence is a known risk of facelift, including scarring more visible than desired. I can glean nothing from the history as presented or post procedure photos ...
  • Causation Probability: 2 / 10
  • Causation Summary: See answer above. Even a “perfect” operation with “perfect” post op care can lead to imperfect result. Neither the result nor the patient’s dissatisfaction indicates a deviation from standar...
  • Expert Summary: I have done hundreds facelifts throughout my career and have seen hundreds of postop facelifts from other community surgeons for complications. My own complication rate is rare but not zero so I can a...

About Us

Kalivar represents a new concept in medical-legal consulting.

Kalivar was founded by two physicians and a lawyer who believe that the medical legal industry deserves an upgrade.

The current state of affairs:

  • Not infrequently doctors are unjustly accused of negligence. At the same time, malpractice victims do not always receive the compensation they deserve.
  • Many doctors are reluctant to serve as an expert witness and do not have time for extensive reviews of medical records. Choosing sides in a dispute between a patient and a peer may be uncomfortable, especially when doctors be deposed or required to provide testimony.
  • The few doctors who serve as expert witnesses often charge high fees to attorneys for an initial opinion. As a result, many attorneys, whether they are representing the plaintiff or the defendant, tend to rely on the opinion of a single expert as the foundation for their case. When that single initial opinion is questionable, significant funds are incurred unnecessarily in legal cases that should never have been initiated, or that instead should have settled immediately.

There is a better way.

We have created an on-line community where doctors can provide anonymous opinions on medical cases, and have the opportunity to be retained as an expert.

Kalivar allows doctors to provide unbiased opinions, as we do not disclose their identity, and we are unaware of whether an opinion is being requested by a defendant or a plaintiff. With only a short event summary to read, busy clinicians can find a few minutes during their day to leave a comment in our social media-like platform (and potentially be compensated for their time!).

Kalivar allows attorneys to obtain diverse opinions from different experts across multiple specialties, for very limited costs. Attorneys will have greater insight into a case before embarking on a long and expensive process that may be unnecessary to begin with.

We hope that you will help us improve the medical-legal industry and join the Kalivar community.

Thank you for your help!
