Case Overview

  • endometriosis
  • laparscopic ovarian cystectomy and robotic assisted excision of endometriosis

Patient was in post op following surgical treatment for endometriosis. After being moved to the second stage of recovery, the patient was assigned a male nurse. He exposed her pelvic region without warning and "examined" the patient's vaginal area without warning or permission while the patient was still recovering from anesthesia and was alone. He also removed her gown without warning exposing her breasts to remove a monitoring sticker on the patient's side and left her ungowned after leaving the bedside. Patient was only able to tell her husband of the events after discharging home and avoided being admitted for pain management out of fear from continued touching. no chaperone was offered or used at any time during the "examination." Case would be against the Hospital for male nurse without a chaperone and potential civil battery claim
Expert must be able to render opinions for nursing standards in Florida (so Florida licensed physician or Gynecology nursing expert, with post op experience)
